Termination of occupancy

I need to know what the procedure is to terminate the occupancy of our current tenant. She was given a one year lease in 1998 and has been on a month to month every since. In the last two months we have had to move in my elderly grandmother (who can not move) and my disabled uncle (who is blind and deaf) with this said we have run out of space and need to make use of our second floor. Is 90 days sufficient enough notice and what else do we need to do?

Typically, you need to provide your tenant with a months notice. If the tenancy is month to month, you would need to proivde notice at least 30 days in advance. Of course other requirements may have to be met if the tenant is elderly, disabled, or a Section 8 tenant.
