Wrong Prescription Given

I recently hurt my back, went to an emergency clinic, was examined by a doctor, and given a script. I went to the pharmacy, filled my script., went home and took it. Pharmasy called and told me I was given wrong script.(someone elses) Luckily no consequenses other than a headache. Do I have any legal action?

How much do you want to collect for a headache? No lawyer will take this case on a contingency fee basis. If you were on the jury how much would you award?

There was a wrong here, but your damages were de minimus. If the wrong prescription had killed you, then your widow would have had a good case [for wrongful death].

Did you find out if the other guy was given your presription? What explanation did the pharmacy give that this will not happen again?

Often people blame lawyers for our litigious society. In fairness, the truth is that some people look to sue at just the drop of a hat [or a prescription].

Our taxes pay for the judicial system. Please spare us frivolous law suits.
