Legal Question in Medical Malpractice in Connecticut

17 Surgeries

Can I file a malpractice case based on a doctor doing too many surgeries to correct the 1st surgery he did. I believe he did the initial damage to my ureter when he performed the first surgery trying to get out a kidney stone. I now have a total blockage and need to have reconstructive surgery. How can I prove all of the other surgeries were to correct the 1st one done with a laser. I also can definately say this doctor made 3 definate mistakes which caused me to go back into the hospital because of his poor judgement. The last time this doctor took out a stent, said he was going to put dye into the kidney to make sure it would drain. I came out of recovery and he said everything was fine, I went home and an hour later I was taken by ambulance because the kidney was backing up. An MRI and an X-ray showed dye in the kidney 8 hours later. 5 days after that I went for another MRI and the kidney still had dye in it. So obviously kidney was not draining. How can I go about this. I have already reported him to the state and I am still awaiting the outcome of that investigation. I did find out after the fact that this same doctor has settled to malpractice claims. I just don't know if what he did can be explained away.

Practicing medicine is complex and unfortunately many things can go wrong. It is very sad that you have received that many surgeries. You seem to have a valid case. Please bear in mind that there are usually many healthcare professionals involved in patient care of a particular patient especially in a hospital i.e. who did what and when. Also a patients kidney function may change drastically during their course of sickness for many reasons such a medications, infections and nutritional status which are not always initially evident.

your lawsuit would be for the deviation of the standard of care in doing the first surgery wrong. The subsequesnt surgeries may allow a punative damage claim against him. This is comlex stuff. I know some great attorneys in CT. I had an office in Hartford and Bridgport for years.
