Legal Question in Medical Malpractice in Connecticut

My wife broke her foot and tore a tendon while walking in NYC. Norwalk hospital took x-rays 7/21 and did not see anything. Chiropractor reviewed xrays and did exams and did not see anything. Was sent to 3 months of therapy yet situation never got better. Got a second opinion and doctor found that foot was broken after reviewing initial xrays taken at Norwalk Hospital, 4 months after the incident happened. Can I sue for malpractice?

Anyone can sue for anything in this country. However, for you to have a case, you will need another doctor who is willing to attest that both the other treating facilities acted counter to the standard duty of care and that a reasonable doctor under similar circumstances would have made the correct diagnosis. You need to also be able to show that your wife was further damaged than she would have been had a doctor treated her for the broken foot in a timely fashion. This is very difficult to prove unless she has some sort of permanent injury as a result of the misdiagnosis. If you would like to discuss this matter further, I would be happy to speak with you.
