Bad Faith Insurance Company

My spouse was struck by a vehicle and was given the insurance information of the driver.

Not long afterwards, their insurance company contacted us; evidently, after they contacted their insurance.

There was also a police report stating that my spouse was struck by this driver's vehicle. The police report # and city, and state was submitted to his insurance company.

Recently, however, we received a letter from the insurance company saying there was no evidence that this driver struck my wife, and they refuse to pay any damages.

Why would they say such a thing?

Is this common practice for an insurance company?

If we contact the state, what will the state do with regards to this insurance company?

Will they have to pay more in damages for saying there is no evidence?

Insurance companies often will deny responsibility for an accident, especially if the person hurt is not represented, unless it is obvious that their driver was completely at fault (and even then they may deny responsibility). Some insurance companies are worse than others. You need to speak to a lawyer to discuss the circumstances to see if your wife has a case. To answer your questions, the State will not do anything and the insurance company will not have to pay more damages (there is such a thing as a claim against an insurance company for bad faith, but you're probably not there yet at this early stage of the case). You do not say how the accident happened, if the police report says the driver got a ticket (there's also a code on the report that indicates who the officer feels was at fault), what time of day, weather conditions, etc. All this information is necessary to assess your wife's case. I agree with John. For reasons as yet unknown you are getting the run around. The fact that you have a police report goes a long ways.

It would appear that you are not going to get anywhere on your matter withour some professional legal help.
