Defendant in slip and fall case on snow and ice

I own a Landscaping business and am being sued for a slip and fall. I dont feel i showed any negligance. the women fell 12 to 13 hrs after a blizzard, the parking lot was plowed and sanded twice prior to the fall. Why am I wrong?

Just because you are being sued does not mean you were wrong - it may mean just the opposite. The fact that there is a lawsuit may very well mean that the woman has a weak case and was not able to settle it. If you plowed and sanded the lot twice during those hours, there's a very good chance that you will not be found responsible. The law does not require that ice or snow be cleared immediately after a storm. The ice or snow must be cleared within a "reasonable" time. How much time is reasonable depends on the circumstances of each case. Many times the property owner's insurance company brings in the plowing company. If you have insurance, you should turn this to your insurance company. If not, give me a call. I have successfully defended ice and snow cases cases at the trial and appeal levels. Why are you wrong? Hard to tell. Did you have a contract with the property owner? Did the property owner check, or sign off on, your work? Plowers get sued all the time. They are usually brought in by the property owner. You may or may not be able to get out of the suit depending on the facts. In most cases, though, it's the property owner that ends up paying the settlement, if there is one, unless the plower really did a bad job.
