Legal Question in Personal Injury in Connecticut

I had a friend over the house for a cook out. We were all drinking beer for a while. The week prior this same person was over my house very intoxicated. I had been punishing my dog for something and this person entered the room and hit my dog a couple of times. My dog snapped at him but I stopped the dog and told this guy to go back out. This next weekend I had put my dog in the room knowing that this guy was here drinking and did not want him to get aggressive towards my dog. The guy had went to the bathroom, then after coming out he went over to my bedroom and reached over the gate to antaginize the dog. My dog snapped at him and this time caught his hand. The dog broke the skin. I told him not to go near the dog but he did. My wife and I offered to clean the wound and also bring him to the er. He refused any type of treatment, saying hes alright and a dogs mouths cleaner than a humans. He continued to drink for about another 1/2 hour than left with his wife. The next day he called and said he went to the hospital and now he has an infection and may need surgery. I did every percaution to keep the dog from any visitors. The dog has never bit anyone yet, but we still dont let him around guests.

Obviously the first thing you need to be concerned about is contacting your homeowner's insurance. If there is possibility that this injury will require substantial treatment then you will want your insurance to cover it. In CT there is a 'dog bite" statute that holds the owner or caregiver of a dog liable for injuries that it inflicts, UNLESS, the dog has been provoked, specifically, "teasing, tormenting or abusing the dog". It is important that when you notify the insurance carrier you advise them of your "friends" prior treatment of the dog.
