Legal Question in Personal Injury in Connecticut

Fell on Foxwood Casino Property

My mother fell going down the marble stairs from getting out of a whirlpool tub in a hotel at Foxwood. She was taken to the hospital via ambulance the hospital took x-rays of her back, ribs, leg and foot the doctor said she had a broken toe and gave her pain meds. Two days later she went to the neighbor hospital with severe pain and was told she had 3 broken ribs, a broken toe and a broken foot in addition to a puntured lung. The doctor in Norwich took x-rays of her back, ribs, foot, leg and toe. My question is what is the personal injury laws of foxwood regarding time lines of notice of claim and does this sound like a good mal-practice case for someone to handle? Please help it happened on July 8 1999.

Re: Fell on Foxwood Casino Property

Your mother has two potential claims: 1) for negligence against Foxwoods if it can be shown that the steps were not safe or were improperly maintained; and 2) a malpractice action against the first hospital for their failure to identify and treat all of her injuries.

Note that the claim against Foxwoods may need to be processed under tribal law if an insurance settlement cannot be reached.

Please feel free to contact me at 401-885-7200 if I can be of further assistance. Although I am not admitted in Connecticut, I do have arrangements with counsel there for association.

Best wishes to your mom for a speedy recovery.
