Food allergy ignored by chef

Hi I ate in a restaurant last week - I took a few clients out to lunch - There was a special that day that had shrimp in it. I asked if it could be prepared without the shrim - I had told the waitress that I was alergic to shellfish. She went and asked the chef - she came back and told me that it would not be a problem - Well I was in the ER swollen face, throat tight - ER dr. said that I was very lucky they could have killed me and I missed my last son's High School Graduation - do I have a case? I live in NY and Restaurant is in CT

I have been through this very same situation before. My father and I both have an allergic reaction to shrimp and have been in a restaurant where this very situation happened. You do have a case.
