personal injury suit against estate

my husband was confined to a nursing home from nov '03 until he died 3/11/04, with 5 trips back and forth to the hospital. he died of respiratory failure and was on several meds, including sedatives, and was largely ''out of it''. i today rec'd a notice of claim from someone at the home suing his estate(there is none--he was on medicaid and title x1x ) because he alledgedly kicked her. i do not know what her injuries are--was never mentioned to me at the home except possibly in passing but definitely not any big deal--where do i go from here? we do not have any money but am i somehow liable for this?willthis atty be contacting me again or is there something i should do? thank you.

I believe that you should seek an attorney to handle the estate with you. It is more than just an estate which has no assets. As I do not know what you have done with the probate court, you should get an attorney to advise you. I doubt that you would be liable but I don't all the facts and assets of the estate. I am responding based only on what you said even though I don't know all the information, such as insurance, property owned and other things, but you need an attorney to get the whole story and give you advice.
