my son slipped and fell in Macy's
i went into Macy's with my children on 1/6/07 and within 5 minutes my son slipped on a clothes hanger and hit his head on the metal rack (a t-stand)and there was blood everywhere.He had to go to the E.R for a laceration on his left forehead.First macy's insisted i don't go to the hospital then on mondathe corporate office calls me to say that i should sumit my son's medical bills to my insurance and if i have any out of pocket expenses that they will pay me for that. Shouldn't they be paying for all my sons medical bills and then some?

You may sue Macy's because they were negligent. Simply put, negligence is when someone, such as Macy's, violates their duty to act with reasonable care for the safety of its' customers. One of these duties, is to maintain a safe shopping environment. Since they may have violated this duty, by allowing the hanger to linger on the floor, you have an ability to recover for your son's injuries.
In order to file suit, you would simply need to pay for filing fees, which are relatively inexpensive. The attorney would only be paid if you monetarily recover.

There is definitely a possibility that you may be able to recover more than just your unreimbursed medical expenses. This would be a negligence action. Typically, how it works is you submit your bills to your group carrier for payment, but keep copies of all of them. You should simultaneously make a claim against Macy's. the total of your bills will be just 1 element of your damges. You are also entitled to pain and suffering and possibly some othet things, depending.
