ex spouse wrongful death

Ex spouse died as a result of car accident. her sister is exec of her will and estate. Can I file suite in behalf of our 10 yr old son outside of the estate??

I'm very sorry for your loss. Unfortunately it is unlikely that you have a causee of action on behalf of your son outside of the estate. I would be interested in learning a few more facts concerning the accident and the arrangements you and your wife had concerning custody, but in general, I dont think would be able to sue under those circumstances.
