In actuality, a lawyer does not file a lawsuit for a specific amount. In cases filed in the Conn state courts, it is only necessary to state if the claim is for more than $15,000, which obviously would apply to this case. In federal court, an amount is required but it is only a formality, so attorneys routinely specify an exceedingly large amount.

To answer your question as to how a lawyer would know how much a case is worth, a lawyer needs to have had enough experience with personal injury cases (I have 20 years experience) to have a sense of how an insurance company or a jury would value a particular case.

With the information you have provided, it is not possible to give you a definite answer as to how much the case is worth. I would need more information, such as (1) are there any questions as to who was at fault for the accident, (2) how much are the medical bills and what part has been paid by insurance, (3) is there permanent disability and how much, (4) will the injured person be able to return to the type of work he or she did before, (5) are there activities that the injured person no longer can do, such as sports, dancing, hiking, etc., (6) how old is the injured party, (5) in what court will the case will be tried, (6) which insurance companies are involved, (7) what kind of evidence has been prepared to show the extent of injuries (photographs, video of rehabilitation, interviews of witnesses, etc.), (8) will there be permanent scarring, and (9) will there be future medical problems (early onset of arthritis, etc.), (10) will there be future medical treatment (surgery, rehab) and how much will it cost, (11) how comfortable, willing, and effective will the treating doctors be in regard to testifying in court.

As you say there "may" be nerve damage, it may be too early to fully evaluate the case. Doctors usually wait until 10 months or so after an accident or surgery to say if there has been permanent disability.
