Worth Pursing Personal Injury Case for Propoerty Damages Only?

My wife was involved in a car accident five days ago where the other driver was at fault - failure to stop (driver of the other vehicle cited by the State Police). Vehicle has severe damage and may be totaled. My wife was taken by ambulance to the local hospital and was treated and released, diagnosis strained rib muscles. No further injuries at this point. Should I pursue this and engage legal council as a Personal Injury case even though we are only looking for compensation for vehicle property damage and reimbursement for out of pocket medical expenses, or should I just take the settlement from the other drivers insurance company.

You may not know the full extent of your wife's injuries, and you will be required to sign a waiver if you accept an insurance settlement that concerns bodily injuries. You can get reimbursed for property damage once the other driver's insurance company accepts liability, without waiving your ability to file a personal injury claim.

In addition to the property damage and medical bills, the law allows you to recover for non economic damages such as pain and suffering and permanant injury as well. It would probaly not be wise for you to even think about closing the file out for at least 60 days. During that period the full extant of your wife's condition will be made known and all of the oddball medical bills will have come in. Assuming all is well at that point, you should be able to close out your file yourself for a fair figure. If things are evn slightly more complex than that, it would behoove you to obtain counsel.

If the other driver is insured by Allstate, or if there is ANY question about them accepting full responsibility for the accident, call a lawyer.

You should wait before settling with the other driver's insurance company. You may not know the full extent of your wife's injuries for a few months and some insurance companies can be difficult to deal with. After you have all the bills and your wife is recovered, you will be in a better position to make that decision. In the mean time, it would be prudent not to waive your right to pursue personal damages.
