Legal Question in Real Estate Law in Connecticut
Attorney error
Four months ago I sold a condominium. The buyer had a local lawyer handle his side of the transaction as did I. This lawyer (buyers) was familiar with the town and in particular the condominium complex. Now 4 months later it has been discovered that the buyer's lawyer failed to discover unpaid taxes at the time of closing apparently due to an improper or incomplete title search. They are now demanding that I, the seller, pay these taxes, even though it was the lawyer's error and lack of due diligence that they went undiscovered at the time of closing.
Isn't this what their title insurance is for and the lawyers professional liability insurance?
