Condo complex is still being used for Section 8 Housing
I recently purchased a one bedroom condo in a 4 unit building. I am the first person to own a unit in the building. The owner of the building, who is converting the units over to condos one by one, told me that the Section 8 tenants upstairs would be out of the building by Oct. It is now almost January and they are still in the unit. Due to other circumstances, I am going to be putting my unit on the market next summer, and I know it will be difficult to sell it with the tenant still living in the building. These are one bedroom units that appeal to professional singles and couples, and she is living there with her teenage son which brings a different level of noise and commotion to the complex. The building owner claims that she has not paid her portion of any rent in months, and he continues to promise that she will be leaving, but nothing is happening. Is there anything I can do to get him to take some action?

Control over condo decisions at this point in the game is complicated and usually resides in the developer until a certain percentage of the units are unit owner controlled. Whether or not you have a claim against the developer/owner of the building depends upon the condo documents and the facts surrounding how he made the promise about the tenancy of the units.
