Legal Question in Real Estate Law in Connecticut
Trying to get deceased Mom's house back
Mom became ill 8 yrs ago. She had no insurance so hospital had her sign over her home and gave her living use. Mom passed away 4 yrs ago. A relative is and has been living in Mom's home for 18 yrs. rent free, and still occupies the home. Current resident, of course, does not want to take any action at this time, however, other siblings do want to take action to legally own the home. The estate hasn't been settled or gone through probate so hospital doesn't know Mom is deceased. Town records show current occupant is paying the property tax but there is no record of a lien on the home. Is there a statute of limitations on how long the hospital can take title to the home? How can we, the children, re-claim and own the property? Does the current occupant, who is a sibling, have rights over ours to take ownership?

Sibling has no superior rights. You must go to probate and open the estate. Hospital may file a claim against the estate. It's the only way to get this cleared up.
