Legal Question in Real Estate Law in Connecticut

Divorce & Quitclaim Deed

My ex-wife and I were divorced in 2004. I signed a quitclaim deed giving her our home. She has not refinanced to remove my name from her mortgage and she is refusing to do so. This is becoming an issue for me now that I am trying to refinance my own home. Actually, the only way I was able to purchase my home is by listing it as rental property because my name is still on her mortgage. The divorce decree does not mention anything regarding this. Is there any legal action I can take to force her to remove my name from her mortgage?

Yes, there is a way to get your name off of the mortgage. You would have to file certain papers with the court in order to initiate the process.

I don't know of anything you can do to remove your name from the mortgage. This should have been done in the divorce action.
