Legal Question in Real Estate Law in Connecticut

easement rights

our neighbors have an easement across our property . in the deed it is written as a passway. they are of the opinion that they have the right to use the property for thier own personal use i.e parking of thier cars parking for guests.etc. they also feel they have the right to make improvements to the passway i.e cutting trees clearing brush putting crushed stone down to widen passway. my question is if I sue them and prevail ,would they be responsible for my legal fees and court costs. or could I.sue them to recover these costs

In Connecticut,attorney fees can only be recovered if written in a contract or permitted by statute.I do not believe you would recover your attorney fees,but you would recover your costs. Dennis P. McDonough
