Legal Question in Real Estate Law in Connecticut

We fell behind on our mortgage payments three months ago (nov. 2009 was the last payment made) due to a hardship.

We requested a modification twice and both times we were denied, I have infront of me a letter stating that we are denied and the advise of GMAC is to sell the property. I called about a short sale last week and started working with a listing agent. I called today to get information on a DLI and I was put on hold for 15min. When the women I was speaking with returned she informed me that our modification request was being re-evaluated. They never contacted me to inform me of this, my question is, is this legal, can they tell you in writing you are denied and then two days later say they are re-evaluating? We have already started looking for rentals and working with a listing agent??

Yes, I think they can do a lot of things that do not necessary sound right.
