Iam renting 1/2 a duplex & just found out that the dwelling is in forclosure. The Landlord has not notified me of this. What are my rights & will I have to move ??

Re: Foreclosure

You do have rights as a tenant. Find out who the lawyer is for the foreclosing bank. If our lease is written, send a copy of the lease to the lawyer; if it's oral month-to-month, write a letter to the lawyer telling him you're a tenant. They will have to amend the complaint to include you as a defendant. Eventually, they will get you out, but you can buy some time. Whether you should still be paying rent is another question. Also, the longer you wait to tell them you're a tenant, the more time you buy, but you have to monitor the foreclosure lawsuit carefully to know when to let them know.
