grandfather apartment

I have a 4 family house in stamford, ct. this house has been in our family for the last 80 years.

one of the 4 apartments is located in the basement. we have had fire marshells out ever 2 years to check the house.

this year they came out and said we would have to remove the basement apt of ceiling ht was not enoght. so the health inspector came and said they would have to move in 2 weeks. but for years we were told that this apt was grandfatherd. can they do this.
