What included in a Title Search ?

When you pay to have a tiltle search done on a property you intend to purchase, should they also check for law suits involving the property? After living in my new home for 9 months I realized the property had a tendency to flood, included in the flood water is overflow from the city sewer line on the street. I recently found out that the previous owner , who did not disclose the flooding issues, had a $5 million law suit against the city. Shouldn't the title search have found this law suit before my closing?

In general, a title search is a search of the land records located at the town clerk's office. Although a lawsuit by a homeowner against the city is public information, such information would generally not be contained in the land records and therefore would not be revealed in a standard title search. If the seller intentionally misrepresented material facts concerning past flooding, you may have a cause of action against the seller.
