Lease issue

I signed a lease for a rental apartment back in Jan 2008. The lease terms are 45-day notice, 1 year and lease terminates Jan 2009. They sent me a lease renewal letter in November 2008 and I signed that document stating I am vacating Jan 31 2009 and not renewing after Jan 2009. In dec 2008 via email I requested what are options if i want to stay beyond Jan 31 2009. They drafted a new letter stating various options asking me to sign before jan 15 2009. I didnt sign that letter but apartment people says that i am liable for Feb and March 2009 rent as I didnt give 45 day notice which i did in Nov 2008. I just asked for options and they are making me liable for Feb and Mar 2009 rents which i didn't commit to. Please advice.

I haven't seen your email, so I can not determine if the wording of your email may have misled them unintentionally. However, assuming your email was clear that you were only inquiring as to options if you were to renew, then I agree that you should not be liable for February and March.

It is not clear to me when the 45 day notice provision runs.

Is there any chance that the November, 2008 letter was returned to them after the 45 day notice deadline?
