I would like to know if it is legal to record a conversation and use that information in court if the person does not know you are recording them?

It is not legal and the conversation's recording would be inadmissable. However, if you overheard the remark, and the remark was an admission against the interest of the person who made it, you could testify that it was what he/she said. Not as good as the recording, but still admissable.
