Legal Question in Real Estate Law in Connecticut

Neighbors Trees in My Yard

My neighbor planted several spruce trees years ago, about 3 feet from our property line. These trees are now huge; and the branches extend into my yard more than 15 feet. They also cut off the sun to my backyard, have killed the grass underneath, drop needles and debris, and the roots are now in my septic fields. I'm tired of losing my yard foot by foot every year - can I remove the branches on my side of the property line, or cause the neighbor to do so? We are not friendly at all.

Re: Neighbors Trees in My Yard

You may cut anything on your side of the property line at your expense.

This is one of those "hot button" neighbor issues, like dogs going next door to relieve themselves and too-loud engines late at night. Understanding that your relationship with your neighbor is strained, I suggest that you try to explain to him the problems the trees are causing you and to work out a solution that won't antagonize him too badly and will still get you the results you need. There's nothing worse than a fence-line war.
