pipe burst in townhouse, any fault?

Hello,

I just had major damage done to my 2000 sq ft townhouse in Connecticut. A pipe burst in our upstairs bathroom under the sink. We bought the house 14 months ago and were given a clean bill of health before we bought. The water damaged our unit and both units on the sides of us. One unit owner is threatening to sue us to pay for his hotel stay while he is out. We both did not have home owners insurance. Do you think we are at fault if there was no negligence in the matter? There were no warnings, it just burst. All units are 23 years old. Thank you!

Fault is a question of fact - they will have to prove that you acted negligently. Withoutfurther examination of the facts (ie. why the pipes burst, who worked on them, etc) it is impossible to tell. Does the HOA have insurance? Why didn't you have insurance? These are all questions that would be important in seeking recovery. Of course, at the end of the day - if the damages are small - you should be able to work somthing out.
