property belonging to the estate

My father passed away he had a will everything went to my mother. My uncle on my father's side now is in possession of an item that we had let another family member borrow and he went over to her house and just took it. How can we retrieve it?

Sounds like your uncle "stole" the item. Go down to the police department in that town and see if they will give him a call and ask him to return it. Maybe they will arrest him if he doesn't, although I don't know what the item is worth.

Your other alternative is to sue him in small claims court.

I also agree the first step would be seeking a return via phone call, discussions, or lastly a phonecall to the police.

It seems from your question that this item may be unique or one of a kind. If that is the case, you could sue your uncle for replevin, seeking the return of the goods. If its just the monetary value your concerned about, then you can sue for damages. What court (small claims or superior) you initiate an action in depends on your specific cause of action and the approximate monetary value of the item.
