Question about Eviction and Selling Home

I've been tight on money the last few months, so i put my house on the market and someone agreed to buy it, so i moved out and rented. Well i i figured with the profit that i sold my home i could pay for the rent. Well the people havent bought the home and im in a bind, because money is tight. I got the summary process eviction today with a return date on 7/10/08. Now when i moved in there were things that i didnt know about, the foundation in the basement is cracked there has been a ton of water ever since i moved in. There are cracks in the ceiling and floors which when i turned the shower on water came pouring on my couch. And the washer drain wasnt hooked up so it poured all over the basement. Is there anyway they would accept an agreement for me to pay them a lump sum when and if i sell my house. And is there anyway i can go after the people that signed an agreement to buy my house but still havent

It sounds as though you have classic landlord/tennant issues here. There are a number of options open to you. First of all you can respond to the eviction with a defense of breach of covenant of quiet enjoyability and breach of covenant of habitability. This should also help remediate your rent problems.
