Quit Deed

My husband had to quit deed over to his ex wife in 1997. However, the quit deed does not take the name of the mortgage. Ever since then she has paid late payments repeatedly on the house and is affecting his credit. She is tight with her money so she won't refinance to get his name off the mortgage. What can we do legally to make her refinance?

The mortgage agreement is different and seperate from the deed. It is essentially a contract. You would first have to look to the terms of the contract. If that does not work, then you will have to resort to other options.
