Real Estate Disclosure

We closed on our home on 5/9/06. Over the past few months we've seen an increase in moisture in our finished basement. Our ceiling recently collapsed. And now we have mold. We were told by several companies that it will be around $10,000 to fix the problem and we would need to strip the entire room down to the concrete (including taking out the 1/2 bath. Then we would need to pay to have the basement refinished once the work is completed. The sellers did not disclose any water problems when we purchased the house, they also were present every time we went to see house. They were even there looking over our inspector's shoulder when he was doing his assessment. We noticed that although it was May when we purchased the house, the sellers always had a heater going in the basement. We thought it was because they were older, but now we're concerned they were trying to cover up the problem. What do we need to do to find out if we will be recoup some of the cost of waterproofing the basement? Do we have a case?

What did the Seller's Disclosure form say about basement moisture? You have an excellent case if you can show that the sellers knew but didn't disclose. Unfortunately, that's often hard to prove.
