I got divorced. My ex-wife and I retained joint ownership on our family home w/her living in it and paying the mortgage. She offered to buy me out. I accepted. We both hired attorneys. I trusted my attorney to look out for my best interests. Two weeks later I find out that she never refinanced to remove me from the mortgage. Now I do not own the home but am still responsible for the mortgage. I would never had agreed to stay on the mortgage. My attorney has basically told me too bad. Do I have any recourse

First of all, it is not clear from your question whether there is a written agreement as to the terms of the buy out. Did you quit claim your interest with a quit claim deed? Was this an oral agreement as opposed to a written agreement?

Were the terms of the buy out included in the divorce decree? If not, why not?
