our property is located at the end of a street with vacant land behind our house. our ''driveway'' is a right of way to our house and the land. this driveway was a once proposed city street that never came about. the ''driveway'' is now sinking in and needs major repair. who's responsible to pave this driveway?

You need to determine who owns the easement. You also should look at the deed to your house. Hopefully, it will say who is responsible to maintain it. You should also look to the deed of the owner of the easement to see if it provides that information.
If you are not successful, then you should work it out with the owner.
