Legal Question in Real Estate Law in Connecticut

Removal Of Ex-Spouse from Home Ownership

My ex-wife left me in 1997. She is an English citizen who previously held an resident-alien card. Since 1997 after separation we divorced, she remarried in 1999, and since then I still reside in the house purchased by me, and paid by me only. I still haven't removed her name from the deed, but wondered since she only lived in the house for 1 year, and since has been gone from the home since 1997, does she still have any rights to the home? I would like to remove her name, but wondered tight now wothout doing so, if she still has any rights to the home. She will never return to this home, and since remarried and now lives with her new husband in England in their own place. Can I simply change the deed to just my name, or do I have to still have to fill out a quit claim deed?

Re: Removal Of Ex-Spouse from Home Ownership

The issue of the ownership of the house should have been done in the divorse action. When the final divorse was granted all property is divided or ownership is ordered. If this was not done and she is named on the deed, a deed from her is necessary to transfer her share of the property to you. You should contact your divorse lawyer for a review of the Judgement to see what action may be necessary. Thanks for contacting us. Thomas F. Noonan
