rid of late Dad's car

My widowed Mom wants to get rid of my late Dad's car.She has registration & title.She'ed lite to get

a small stipend.All places called say

they need proof from an executrix.

There was none.No reading of a will,nothing.He died , she just went

on. How can she legally get his car

out of the driveway? Thank-you.

Hello. This is a common problem for couples, when one passes away. Unfortunately, you'll need to clear title to your father's car (and any other assets, e.g., house, bank accounts, etc.). Even without a will, your mom will need to probate your father's estate. In cases like this, where everything is simple and straightforward, it doesn't take long to do. You can go to the Probate Court and get the forms yourself, or you can hire an attorney to do it.

Once the probate of your late father's estate is finished, your mother will receive a document she can take to the DMV to have the car re-title in her name. Then she can sell it, register it, or whatever she wants to do.

If there isn't much to your Dad's estate, it may qualify for the filing of a "simple" estate in the probate court which requires minimal forms, such as an affidavit in lieu of estate. Call the probate court where he lived.
