Legal Question in Real Estate Law in Connecticut

Selling by owner

If I sell my own home in CT without the use of a real estate agent, then a real estate agent brings a buyer to my house and he decides to buy it, who pays the fee to the buyer's agent? Does it come out of my asking price, or does he pay it in addition to the negotiated price?

Also, what is the best way to find a lawyer to see me through the FSBO selling process, including providing a contract, etc?

In most cases, a buyer's agent will approach you and ask you if you are willing to pay half the normal commission rate if they have a potential buyer. It is up to you if you want to pay this.

It will depend on the contract with the buyer's agent. If it is truly a buyers agent then you will not need to pay. If it is an agent working on general commission schedules, they may want you to pay. It sounds like you are not under an obligation to do so. (It is usually a good idea to protect the buying agent on his or her commission though, because you will broaden your pool of people who will show the house.) Just ask a potential attorney if they are comfortable with the process.
