Legal Question in Real Estate Law in Connecticut

Hello Sir/Madam,

I recently shifted from India to US. I am staying currently in hotel.

I booked a rental flat in stamford in one community. While booking, I told them that I shifted from India. all submitted

photo copies of my passport, visa, indian salary slips, US salary slips etc all documentation. They asked me for 2 deposit

checks. 500$ as deposit check and 200$ as apartment moving charges (100$ per person, we are 2 person -husband, wife and

infant baby).

They haven't reverted back anytime saying that my application was denied. After 2 weeks, i called them and then they told

that my rental application got denied with the reason that they ran my credit history report for 3 years and i don't have

credit history for 3 years.

The fact that I recently moved to US , the apartment leasing agent knows clearly that I dont have 3 years credit history

in US. Still they processed my application.

Also surprise is they have processed 200$ check which is apartment moving charges.

As i haven't moved in apartment, are they allowed to do such thing by law?

Can I sui them for it?

I have my bank statements which proves it and I have all papers for my rental application with me.

They can insist on 3 years credit (even if the rental agent knew you had just come from India), but they can't keep the $200 unless they have something in writing signed by you making it very clear that the $200 is non-refundable (which I very much doubt).
