Legal Question in Real Estate Law in Connecticut
Special assessment after closing
I recently bought a condominium in Connecticut. A couple of months after I moved in I received a bill in the mail from the local sewer commission for a special assessment (we didn't know about it before the closing so we didn't have any information prior to this). They included in the bill two years worth of unpaid payments with penalties and interest from the previous owners who never paid their bill. Am I responsible for paying thier unpaid portion?

I agree with Attorney Heffernan. When preparing for the closing, sewer charges are routinely verified and the unpaid charges,as well as payments made in advance are calculated as part of the HUD statement and closing statement. If there were any liens placed against the property for sewer charges, this would have showed up on the title search as well.
You should check your own paperwork first, then call your former attorney and request that this be straightened out.

Your lawyer should have checked on the sewer bill before closing. If the seller is still around, you can go after the seller.
