tenant in jail

I have a tenant that was arrested & is now in jail for 2 years or more,that still owes me a month and a half''s rent,never gave me deposit,and his mother called me and said her son asked me to store his stuff.I have someone who is going to rent it in 2 weeks.Should I send him a letter stating that he has broken the lease & taht I will store his stuff for 1 month only and that I am not responsible for anything lost or missing?. Do I still have to send him a letter to Quit? Thanks

You didn't mention what the duration of the lease is.

I assume the lease is for a term far less than his jail term. Unless he agrees to pay the rent while he is in jail, then he anticipates breaching the lease. From your question it appears he already has. I don't see why you would have to bother with a notice to quit. He isn't coming back.

I think your idea of sending the letter and storing his stuff for one month is fair.
