Man on Man Sexual Harassment
My husband has been with a major company for 16 years in management, last week, kidding around to get one of his employees going, he patted him on the butt, similar to the way football players do. Now this employee is claiming sexual harassment, All parties involved had to sit down with upper management where my husband apologized for his poor judgement and assurred the employee that he was just kidding and meant NOTHING sexual by it. My husband is also willing to move to another area so that he isn't involed with him anymore. Management feels the claims are groundless but need to follow the right protocol to cover the company. Recently, this employee said he couldn't talk to management by orders of his lawyer, although one has not been in contacted with the company. My husband was going to get a promotion this year because he is a good and vauled part of this company. In all of his 16 years there has NEVER been a complaint towards him of any kind. Could this person come after us personaly? Is there a time frame for when he would need to take action?Thank-you for your time this is very troubling to my husband and any advice you could give would be very helpful .

Under recent US Supreme Court decisions,
a company may be vicariously liable for the
manager's sexual harassment conduct. You ask, however,
if the manager may also be liable. Our RI federal
judge recently held "Yes." He parts ways with
several other decisions because, interestingly,
he ruled that unlike the company, the individual
is subject to an award without limit.
In RI, because we are a dual-filing state,
the victim has 300 days from the incident to
file a claim with the EEOC.
