Legal Question in Social Security Law in Connecticut
Social Security and a divorced Mom
Hello,
My ex husband died recently and I am confused about if I qualify also. We were not married for over 10 years but then I read this...
''Benefits for surviving divorced spouses
If you have been divorced, your former wife or husband who is age 60 or older (50-60 if disabled) can get benefits if your marriage lasted at least 10 years. Your former spouse, however, does not have to meet the age or length-of-marriage rule if he or she is caring for his/her child who is under age 16 or who is disabled and also entitled based on your work. The child must be your former spouse’s natural or legally adopted child. '' I live in CT and my child is under 16 years of age. Thank you for any help!

As I read that, if your child is his child (and the child is under 16) you win. You should call your local SSA office and they will go over it with you on the phone. They are actually pretty helpful.
