Legal Question in Wills and Trusts in Connecticut
My 85 year old father was appointed executor of his deceased sisters estate.
He has dementia and my sister has power of attourney for him. She wrote thousands of dollars of fradulent checks from the estate account . Her son who has a heroin problem and is a repeat felon is also complicit. She is also manipulating the other beneficiares including my father. One cousin is attempting to question the accounting of the estate but does not want to hire an attourney. Will the court investigate the funds that were misappropriated and hold them responsible ?
1 Answer from Attorneys
No one is going to investigate anyone unless someone brings it to the court's attention. Why isn't anyone notifying the court that your sister's power of attorney should be revoked and she should be prosecuted. Why is your father the executor if he has dementia?
You don't need an attorney to notify the court of this incident.
