My aunt passed away and left her estate which included an inheritance to her four nieces and nephews and her brother (who was the executor). Her partner lived with her, but was not listed on the mortgage, which is underwater. This partner has minimal income, and is not able to pay the mortgage, taxes, or utilities. The bank is now attempting to collect on the mortgage debt. The executor, intends to allow the partner to live in the house until the bank forecloses and removes him. What type of exposure do I have as an heir? Can the bank recoup the inheritance that I received previously? What type of attorney would be best for me to hire, probate or real estate?
