Codicils

I have a client who is in a local hospital ICU unit. She wants to make a codicil changing the guardian for her minor children. She is bedridden and can't tell me the exact ''article'' of her will that has the guardian provision or the date when the original will was executed. Can I draft the codicil without making specific reference to the previous article or date of the original will?

I think you can make the codicil without the specific article containing the guardianship provision as well as without the date of the last will, so long as you identify the changes as being made to the most recent last will she executed. If she remembers the name of the attorney who drafted it, you can always call him/her to see a copy of it. Furthermore, if she remembers where she put the will (a safety deposit box or closet in her home) you can always have someone look for it under a limited, specific "power of attorney."
