Contesting a Will

I need to know the process for contesting a will. How do you go about it? Specifically when you are overseas -- can you retain a lawyer (from afar, without being present) and then what happens? Does it go to court or is it handled by mediation-type meetings between the parties involved and their lawyers?

You can hire a lawyer here from where you are. Whether or not you would have to come here at some point depends on whether or not you have testimony to give the court. Even if you do, it is possible to take your deposition where you are and use the transcript here (it's expensive that way, though).

Obviously, parties try to negotiate a settlement between the attorneys, but a trial is always possible.

Lawyers don't take these cases on a contingent fee basis, usually. It's payment by the hour, with an up front retainer.
