My mother passed away Oct 2007. She has four daughters - one of my sisters lived with our mother whom I have asked to show us a copy of mom's will. However, my sister has not respond to our request. (Our father died over 15 years ago) There is a home that is involved in this estate. My sisters and I would like to sell this home and split the proceeds between the four of us. But our sister who lives in the home has been silent - not responding to our phone calls. Or, my sister who still lives in the home, may remain in the home if she would pay me and my other sisters 3/4 of the FMV of the house. Questions: How can I get a copy of our mother's will- since my sister refuses to show us the will? I'm not certain, but my sister, who's in the house might have been given POA before our mother died. How would this effect my sisters and I? My sisters and I don't want to lose what is entitle to us due to one sibling not cooperating. How can I find out if my sister has POA? I don't want to loose the house, because my sister living there may have other plans. Who is responsible for paying the taxes? My income is limited and I'm willing to do as much as I can on my own and involve an attorney only if necessary. Please advice. Thank you

Let's hope your sister doesn't have a POA and already tranferred the house to herself. You can always file an application to open an estate for your mother. That will force your sister to either come up with the will (if there is one), or at least let you open and take charge of the estate and the house and sell it. For that I'll need a death certificate (or at least the date and town of death) all the siblings names and addresses.
