Hardship Exemption

My father left an estate, but no will, it is in probate. Is it legal for me to request a hardship exemption to purchase a car {not even new}, as mine is about dead, without it I cannot get a child to school and I cannot get to work. There is enough money comming to me. I have sent the request to the lawyer, but have not heard from him.

You can ask for a "preliminary distribution", but it's up to the fiduciary (Administrator) as to whether or not to give you one. Often, if the claims period has passed, so he knows what debts the estate has, and he knows what the assets and administration expenses are, he'll made an early disytribution to you; but he doesn't have to.
