Legal Question in Wills and Trusts in Connecticut
Refusing to leave house in trust
My brother, sister an I are beneficiars under a trust. My is brother is living in the house and refuses to pay rent or have us put the house up for sale to distribute the proceeds evenly. How do I go about forcing him to leave? I live in IL and I am the Trustee.

Re: Refusing to leave house in trust
If the house is owned by a trust for which you are the trustee, then, unless the terms of the trust provide otherwise, you have the power to take all actions with respect to the property, including putting it up for sale, and if need be, evicting someone in possession of the property.
As trustee, you may have a duty to make sure the property is productive and that you are protecting the interests of all beneficiaries.
