who has the rights to the deceased remains

My brother in law was cremated and his wife wants to keep the remains in her posession. The rest of his biological family would like to see the remains burried in a family plot next to his brother. Who has the rights to say where his remains should stay. They have only been married for a little over two years and have no children from their marriage. There are surviving heirs but only one over the age of 18 but she is from his first marrage and two children from a second marrage. Who has the last say, his wife or his mother and siblings?
