Legal Question in Wills and Trusts in Connecticut

Hi- My sister, age 53, recently passed away. When we were going through her

things we discovered two diaries. We are not certain whether we have the legal

right to read them, or whether or not it would be in our best interest to read them.

Does she retain any right to privacy after her death? Do we have an obligation to

protect her privacy?

That's a very interesting question. As far as I know, generally, any right to privacy a person may have ends upon death. There is some speculation that this rule could be changing, especially with the growth of the internet, and that relatives may have a cause of action to protect the privacy rights of their deceased loved ones.

That being said, I don't see any legal problem with you and your sister's other loved ones reading her diaries. Remember, however, that if it bothers you, the issue could be a moral one, not a legal one.
